Race
City RV Products, LLC (RCRVP) warrants this product
against manufacturing defects in material ands
workmanship, excluding corrosion damage, for a period of
(1) year from the date of purchase from RCRVP or an
authorized dealer. Proof of date of purchase must be
presented for warranty work to be performed. Any Liability
under this warranty shall be limited to repair or
replacement of any defective work or material. The product
must be delivered FOB to Mooresville, NC for any warranty
work performed. RCRVP shall be liable for no other damages
or losses. Replacement or repair of any part or product
under warranty shall be at no charge to the purchaser
This
warranty does not cover: transportation costs for warranty
work, the cost of any repairs other than those performed
by RCRVP, damage or failure caused or attributable to acts
of god, abuse, misuse, corrosion, improper or abnormal
use, damages or failures caused by use in commercial,
applications, additions, deletions or modifications not
installed by RCRVP, damage to a vehicle in tow, any damage
arising out of or in connection with the use or
performance of the product, or improper maintenance.
The
Limited warranty described above shall be in lieu of any
other warranty expressed or implied, including, but not
limited to, any implied warranty or merchantability or
fitness for a particular purpose.
The
parties agree that the buyer's sole and exclusive remedy
against RCRVP shall be for the repair or replacement of
manufacturing defects in material or workmanship as
provided herein. The buyer agrees that no other remedy
(including, but not limited to, incidental or
consequential damages for loss of profits, loss of sales,
injuries to persons or property, costs of removal,
installation, or reinstallation, storage fees, or any
other incidental or consequential loss) shall be available
to him.
The
parties agree that the buyer has had the right to fully
examine the merchandise described in this contract and
further agrees that implied warranties, expressed or
implied, are excluded from this transaction and shall not
apply to the goods sold.
RCRVP
or its representative may have made oral statements about
the merchandise described in this contract. Such
statements do not constitute warranties, shall not be
relied on by the buyer, and are not part of the contract
for sale. The entire contract is embodied in this writing.
This writing constitutes the final expression of the
party's agreement, and it is a complete and exclusive
statement of the terms of that agreement.
